Heard the learned counsel for the petitioner and the learned standing counsel for the respondent nos. 1, 2 and 3.
The instant writ petition has been filed seeking following relief:
"(i) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to get the matter enquired regarding the transfer of the Vikram (Taxi) Registration No. UP-70-CT-3413 in favour of the petitioner and again transfer of that Vikram (Taxi) Registration No. UP- 70-CT-3413 to respondent no. 5 from the petitioner.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondents not to recover any fine or compounding charges from the petitioner regarding the alleged Vikram (Taxi) Registration No. UP- 70-CT-3413.
(iii) Issue any suitable writ, order or direction, which this Hon'ble Court may deem fit and proper in the circumstances of the case.
(iv) Allow the writ petition with cost in favour of petitioner."
Learned counsel for the petitioner submits that a challan of a vehicle has been issued against the petitioner whereas the petitioner is not the owner of the said vehicle. In this regard the petitioner has approached the respondent no. 2 by filing a representation but no decision has been taken and the petitioner is being unnecessary harassed.
Learned Standing counsel submits that the respondent no. 2 may be directed to consider the representation moved by the petitioner and appropriate order shall be passed within the time as may be granted by this Hon'ble Court.
Considering the submission advanced by the learned counsel for the petitioner and the learned Standing counsel, we are of the considered opinion that the respondent no. 2 shall consider the representation dated 6.8.2020 moved by the petitioner annexed as (Annexure 3 to the writ petition) expeditiously within a period of four weeks from the date of receipt the copy of this order.
The writ petition is accordingly disposed of.
