Heard learned counsel for the applicant and learned A.G.A. for the State.
Present application under Section 482, Cr.P.C. has been filed for a direction to the appellate court to decide the applicant's application dated 27.6.2019 (7Kha) filed under Section 421, Cr.P.C. on the next date fixed, which is pending before the Session Judge, Ballia in Criminal Appeal No,.14 of 2019, Ranjeet Kumar Vs. State of U.P. and another arising out of proceeding under Section 138, Negotiable Instrument Act.
The contention of learned counsel for the applicant is that although the appeal was admitted, but the amount, as per the interim order passed by the appellate authority, has not been deposited and therefore, the application was filed for issuance of recovery warrant for levy of fine. Said application remain pending and the next date fixed is 9.8.2019.
Under these circumstances direction is issued to the Session Judge, Ballia to decide the application 7 Kha dated 27.6.2019, if possible on the next date fixed or within a period of two months from the date of production of a certified copy of this order before him.
The application stands disposed of.
