We formulate the substantial question of law as under :

"Whether in the facts and circumstances of the case the Hon'ble Customs Excise & Service Tax Appellate Tribunal has correctly come to the conclusion for paying 25% penalty ?"

Issue Notice to the respondent. Paper book be filed within three months.
