Rule qua the petitioner No.1. Mr. S.R. Divetia, learned A.P.P. waives service of the Rule. Learned counsel for the petitioners Mr. Thakkar seeks the permission to withdraw the prayer for bail qua the petitioners No.2 to 10. The permission is granted. The petition stands disposed of qua the said petitioners.
The petitioner No.1 herein is hereby ordered to be released on bail in the sum of Rs.5,000/- and P.B. of the like amount to be presented before the Court where he came to be convicted.
There was an order for the expeditious disposal of the appeal and the Criminal Appeal is on the final hearing board. It is not being heard for want of the paper book. We request the Registry to see that the paper book is ready as early as possible and at any rate by the end of February 1997. It shall also be open to the learned counsel for the appellants to furnish the duly prepared paper book. If this is done, the appeal should come up for final hearing in the first week of March 1997. If by chance this is not done, the appellants No.2 to 10 shall be at liberty to move this Court once again by taking out appropriate proceedings for bail. The petition stands disposed of with the abovesaid orders.
Rule qua the petitioner No.1 is made absolute.
