Heard learned counsel for the petitioner and Shri Vikas Budhwar, learned counsel for respondents no. 1.
From perusal of the averments made in the writ petition and other material brought on record, it transpires that the respondent no.1 had issued a letter of intent in favour of respondent no.2 appointing him as LPG, Distributor on 7.9.2017. Since the respondent no. 2 has a long criminal history and the advertisement under which the respondent no.2 was issued letter of intent clearly stipulates that the persons having criminal background shall not be eligible for being appointed as LPG distributor, the petitioner filed complaint against the respondent no. 1 before the respondent no.1 disclosing therein criminal history of the respondent no.2 with prayer to cancel the letter of intent issued in his favour.
When the matter was taken up today, Shri Vikas Budhwar, learned counsel for respondent no. 1 stated at the bar that show cause notice has already been given to the respondent no. 2 by the respondent no.1 on 19.4.2018 requiring him to show cause as to why the letter of intent issued in his favour may not be cancelled.The photo copy of the show cause notice issued to the respondent no. 2 by the respondent no. 1 has been produced by him before the Court which has been taken on record.
In view of the statement made by Shri Vikas Budhwar, learned counsel for the respondent no. 1, the writ petition is dismissed as infructuous.
