Heard Mr.Shelat, learned advocate for the applicant, Mr. Abhichandani, learned advocate for the opponent no.1 (Original Petitioner in Special Criminal Application NO.36 of 2009), Mr.Jani, learned Public Prosecutor for the Opponent Nos.2, 6 to 9 and Opponent NO.4-Mr.Ananj Gowami, who has personally remained present before this Court.
Mr.Jani, learned Public Prosecutor read over the order dated 17.02.2012 passed by the Hon'ble Apes Court in S.L.P (CRIMINAL) NO.3556 OF 2011, so also order dated 21.02.2012, passed by the Hon'ble Apex Court regarding minor correction in earlier order dated 17.02.2012. The bare perusal of the order dated 17.02.2012 would suggest about the investigation, which was directed to be made and after the report of investigation is filed, for the effective disposal of Special Criminal Application No.36 of 2009, what steps are required to be taken.
Mr.Abhichandani, learned advocate for the original petitioner in Special Criminal Application No.36 of 2009 states that he would require some time to take appropriate instruction from his client regarding the compliance of the order passed by the Hon'ble Apex Court for the purpose of effective disposal of the matter pending before the Court.
Mr.Anand Gowswami-Opponent no.4 shall remain present on that day and necessary direction be issued to the concerned jail authority. S.O. to 05.09.2012.
