By an order dated 21.12.2012, this Court had expressed that as observed by the Apex Court in order dated 17.2.2012 passed in Special Leave Petition (Civil) No.24358 of 2009 along with Special Leave Petition (Criminal) No.3556 of 2011, the petitioners before the Apex Court may be made party to this matter.
Mr.
K.V. Shelat, learned advocate for the applicant in Criminal Misc. Application No.3056 of 2009 was also to explore the possibility of filing an application. Mr. P.R. Abichandani, learned advocate for respondent No.1 in Criminal Misc. Application No.3056 of 2009 has taken instructions as per the order dated 21.12.2012 and states that respondent No.1 intends to file an affidavit and place on record certain facts which are necessary to be considered by this Court. Learned advocate for respondent No.1 shall file such an affidavit on or before 10.1.2013. S.O. to 18.1.2013.
Party-in-person, respondent No.4 in Criminal Misc. Application No.3056 of 2009 Anandgiri Hiragiri Goswami is present and shall remain personally present on the next date of hearing. Necessary order be issued to the concerned jail authorities.
