JUDGMENT / ORDER

Petitioner is the mother of deceased Rajendran. He was murdered and a case is registered against accused under various provisions of the Indian Penal Code including Sec.302. Case is now pending for trial before the first Additional Sessions Court, Palakkad as S.C.No.197 of 2012. Petitioner approached this Court seeking a direction to the State to appoint a Special Prosecutor to conduct the trial.
2. Learned Director General of Prosecution submits that petitioner's request has been accepted and however, on account of want of consent from the proposed advocate, necessary order could not be issued.
3. It is submitted that consent has been given to the District Collector. In view of the above, the third respondent is directed to forward consent from the lawyer to the second respondent immediately. Thereafter, second respondent shall issue necessary orders in this matter within a period of two weeks. It is submitted that trial is scheduled to be held on 02.12.2014. In view of the above, trial is directed to be deferred W.P(C).No.28214 of 2014B 2 for a period of one month.
The Writ Petition is disposed of as above.
