Diwakar Maddur, HCGP) This petition is filed under Section 439(1)(b) Cr.P.C., praying to relax the condition No.”V” “petitioner shall not leave the jurisdiction of the trial Court without prior permission of the trail Court” imposed on 26.06.2018 in Crl.P.No.3128/2018 (Cr.No.288/2017) of respondent-Hebbagodi Police Station, Bengaluru Rural District, pending on the file of the Additional District and Sessions Judge, sitting at Anekal, Bengaluru Rural District in S.C.No.5008/2018 for the offence punishable under Sections 302, 307, 436 of IPC and etc.
This petition coming on for Orders, this day, the Court made the following:
ORDER After hearing the learned counsel for petitioner for sometime, it is submitted by learned HCGP that already this Court has rejected the application for relaxation of the condition by two times. Hence, the petition is not maintainable. Thereafter, learned counsel for the petitioner submits that he wants to withdraw the petition. Accordingly, learned counsel for the petitioner has filed a memo for withdrawal of the petition.
Memo is taken on record.
Hence, petition is dismissed as withdrawn.
