Order:
This Writ Petition is filed with the grievance that while bifurcating the petitioner’s fair price shop, respondent No.2 has acted with discrimination by making an uneven distribution of the cards among the existing fair price shops.
The petitioner’s grievance is that while in respect of some of the existing dealers, who hold higher number of cards, only 100 to 200 cards were deleted and allotted to the newly created fair price shops, in the petitioner’s case, respondent No.2 has distributed the cards equally between his fair price shop and the newly created fair price shop.
In my opinion, as the distribution of cards between the existing fair price shops and the newly created fair price shops is a part of the bifurcation process, the petitioner is entitled to avail the remedy of appeal.
In this view of the matter, I am not inclined to entertain this Writ Petition for adjudication on merits. However, the petitioner is left free to avail the remedy of appeal.
Subject to the liberty given to the petitioner as above, the Writ Petition is dismissed.
As a sequel to dismissal of the Writ Petition, WPMP.No.49543 of 2014, filed by the petitioner for interim relief, is dismissed as infructuous.
