Learned counsel for the petitioner contends that although it has been consistent stand of District Inspector of Schools, Sultanpur, that the post of Clerk needs to be filled up by way of promotion from Class IV employees, for which the petitioner is entitled, the Management is adamant in filling the post by way of direct recruitment.
Respondent nos.1 to 4 would be represented by Sri Pankaj Patel, learned Government Advocate.
Issue notice to respondent nos.5 and 6, returnable on 18.9.2012. Dasti also.
Manager of Committee of Management, Ranveer Raj Kumar Inter College, Sultanpur, shall remain present in court with his stand as to under what circumstances and under what authority of law the order passed by the District Inspector of Schools, Sultanpur is not being followed in regard to filling the post of Clerk by way of promotion.
