Heard learned counsel for the applicants, learned A.G.A. and perused the entire record of the case.
The submission of learned counsel for the applicants is that co- accused Parvind Verma @ Parvind Kumar has already been granted bail by this Hon'ble Court vide Criminal Misc.Case No.8801(B) of 2009, dated 18.12.2009 and the case of the present applicants is on better footing than that of co-accused Parvind Verma @ Parvind Kumar. Learned counsel for the applicants claims parity, which is not disputed by the State counsel. The applicants are in jail since 4.1.2009, as averred in para 2 of the bail application, which is admitted by the State. Considering the overall aspects of the matter, I hereby provide that the applicants be released on bail in Case Crime No.714/2009, under Sections 395, 376 IPC & Section 3 (2) (5) SC/ST Act converted under Sections 147, 323, 342, 504, 506 and 3 (1) (X) SC/ST Act, P.S. Kotwali Nanpara, Patti,District Bahraich, on their filing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
