Supplementary affidavit filed by Sri Ishwar Kumar Upadhyay, learned counsel for the petitioner is taken on record.
Heard Mr Ishwar Kumar Upadhyay, learned counsel for the petitioner, Sri Gyan Prakash, learned counsel for the C.B.I. and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to direct the respondent authorities to appoint an appropriate investigating agency for investigation of the Case Crime No. 1022 of 2014, under Sections 419, 420, 409 IPC, P.S. Kotwali, District Ballia.
Learned counsel for the petitioner submits that the petitioner is the informant of the case. He has filed supplementary affidavit and tried to show to the court regarding locus in filing the present petition before this Court in paragraph nos. 2 and 3, but we are not satisfied with the said facts as the similar matter is being investigated by the C.B.I.
Learned A.G.A. could not dispute the aforesaid fact as argued by learned counsel for the petitioner.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of two months from the date of production of a certified copy of this order in accordance with law.
The S.S.P., Ballia shall ensure the compliance of present order within the aforesaid period.
With the aforesaid order, the present petition stands disposed of.
