Advocate for the applicants and perused relevant papers annexed with this application together with the copy of FIR sought to be quashed in these proceedings. Mr. Gandhi, Ld. Advocate for the applicants submitted that even the bare perusal of the FIR does not reveal the ingredients of the offence punishable under section 406 of the Indian Penal Code. Mr. Gandhi in support of such submission, read over relevant part of the FIR.
2. Considering the facts and circumstances of the case and considering the submissions advanced on behalf of the applicants, RULE returnable on 09/03/2012. Mr. Raval, Ld. APP appears and waives service of rule for respondent no. 1 - State. Interim relief in terms of para. 18 [b] is granted till further order.
