Heard learned counsel for the petitioner, learned standing counsel for respondent Nos. 1, 2 & 4 and Sri Prabhat Tripathi, learned counsel for the respondent no. 3.
A preliminary objection was made by Sri Prabhat Tripathi, learned counsel for the respondent no. 3 that the petitioner has an efficacious alternative remedy of filing a Revision under Section 41(3) of the U.P. Urban Planning and Development Act, 1973.
Under such circumstances, no interference is warranted in the writ petition.
However, it is provided that if petitioner files a Revision within a period of two weeks' from today then the Revision shall be entertained without going into the question of limitation. Copy of this order would be duly certified by the petitioner's counsel. In case of filing of revision along with stay application, Revisional Authority is directed to decide the stay application within one week from the date of filing of revision.
With these observations/directions, the writ petition stands dismissed.
