It is stated that petitioner possesses the qualification of D.Ed. (Special Education), and in view of the law clarified by this Court in Special Appeal (Defective) No.130 of 2014 (Harsh Kumar and another Vs. State of U.P. and others), decided on 5.2.2014, petitioner is entitled to be considered for appointment pursuant to notification issued on 15th October, 2013. The Division Bench judgment dated 5.2.2014 has otherwise attained finality with dismissal of special leave petition. It is stated that petitioner had applied pursuant to advertisement issued, but her claim has not been considered so far. It is stated that about 56 posts are still lying vacant but the authorities are not considering petitioner's claim. A representation in that regard has also been made before the District Basic Education Officer on 15.12.2017, which is stated to be pending.
Sri V.K. Srivastava, learned counsel for the respondents, submits that grievance of petitioner shall be examined, in accordance with law.
Considering the above, this writ petition stands disposed of permitting the petitioner to approach respondent no.3, in respect of her grievance annexing all relevant materials in support of her claim, alongwith certified copy of this order, within two weeks from today. In case such a claim is raised, the same shall be examined by the authority concerned, in accordance with law, by means of a reasoned speaking order, within a further period of three months, thereafter.
