Heard Shri Aushim Luthera holding brief of Shri Anurag Vajpeyi, learned counsel for the petitioner.
This petition has been filed for a direction to the court below to decide the Application No. 122 of 2013 (Ruchi Singhal Vs. Kapil Mittal) filed under Section 13 of the Hindu Marriage Act, 1955 expeditiously.
It is the contention of the learned counsel for the petitioner that conciliation proceedings had unsuccessfully taken place in the year 2014 and ever since then, the matter is pending before the court below and the petitioner is put to extreme harassment due to the case not being expeditiously decided. It is contended that the defendant-respondent no. 2 is intentionally delaying the decision of the case.
A perusal of the certified copy of the order-sheet reveals that the case is fixed for evidence of the P.W.1 and the next date fixed was 17.12.2018.
Considering the facts and circumstances of the case and the fact that the case is one of the dissolution of marriage and the petitioner has stated that she is a single parent, the court below is directed to decide the aforesaid case as expeditiously as possible and preferably within six months from the date a certified copy of this order is filed before it.
It is made clear that no unnecessary adjournments shall be granted to any of the parties.
With the aforesaid observation, this petition is disposed of.
