Ruchi Devi, petitioner-1 appears before the Court. She claims to be major and states that she voluntarily married to Sachin alias Satyendra Kumar, petitioner-2. In support of her claim, Ruchi Devi, petitioner-1 filed her Aadhar card in which her date of birth has been shown as 1.1.1997.
The counsel for the petitioner states that the marriage was also registered in the office of Marriage Registrar and marriage certificate has also been filed along with the writ petition. Ruchi Devi, petitioner-1 is major, therefore, no useful purpose will be served in arresting the petitioners.
In the facts of the case, the writ petition is disposed of with direction that petitioners shall not be arrested in pursuance of FIR dated 24.12.2018 registered as Case Crime No. 0654 of 2018, under Section 364 IPC, P.S. Bidhuna, Distt. Auraiya, till submission of police report under Section 173 (2) Cr P C.
