Heard Sri Krishnaji Khare, learned counsel for the applicant.
This transfer application has been filed for transferring the Case No. 17 of 2019 (Raja Ram Vs. Ruchi Devi), under Section 13 of the Hindu Marriage Act from the Court of Principal Judge, Family Court, Chandauli to District Ghazipur.
Office report of 25.11.2019 is that the notice was issued to the sole respondent on 23.8.2019 by registered post fixing 30.9.2019 and the tracking report is that the item has been delivered.
No one has put in appearance nor any counter affidavit has been filed on behalf of the opposite party.
It is contended that no expenses are being given by the opposite party and the applicant is fully dependant on her parents. It is stated that she is suffering from chronic disease so the expenses of her diagnosis is being spent by her father who is not in a position to bear the expenses of such litigation, which is going at Chandauli.
The grounds raised in the affidavit filed in support of the transfer application appears to be justified in the facts and circumstances of the case and suited to the convenience of the applicant who is the wife of the opposite party.
This application is, accordingly, allowed and the aforesaid case No. 17 of 2019 is transferred to the competent court at Ghazipur.
