Heard Sri Satish Chandra Dubey, learned counsel for the petitioner and the learned Standing Counsel for the State- Respondents.
The petitioner in the writ petition is seeking a direction to the respondents to decide his representations dated 19.11.2018 and 28.11.2018.
A perusal of the representations show that what the petitioner is actually seeking is setting aside the election of the respondent no.3-Anchal as Adyaksha, Zila Panchayat, Muzaffarnagar.
This is an utterly misconceived writ petition which is an abuse of process of Court since the election of Adyaksha, Zila Panchayat cannot be quashed on a mere representation and can be set aside only through election petition.
The writ petition is dismissed with cost of Rs.5,000/- against the petitioner.
The amount of Rs.5,000/- shall be deposited by the petitioner with the Registrar General of the Allahabad High Court within one month from today. If the same is not so deposited the Registrar General shall take steps for recovery of the same from the petitioner in accordance with law as arrears of land revenue. The amount so deposited shall then be transmitted to the account of the Allahabad High Court Mediation and Conciliation Centre, Allahabad.
Let a copy of this order be placed before the Registrar General of this Court for information.
