Heard Sri Sanjay Kumar Singh, learned counsel for the petitioner, Sri S.S.Sachan, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioners with a prayer to direct the Superintendent of Police, Ballia, District Ballia, respondent no.2 to look into the matter and accordingly take appropriate decision into the matter directing the Investigating Officer of Case Crime No.23 of 2018, under Sections 323, 498-A I.P.C. and Section 3/4 D.P.Act, Police Station Reoti, District Ballia to ensure the fair and speedy investigation of the case within some stipulated period.
It has been contended by learned counsel for the petitioner that petitioner is the informant of the present case and she has come up before this Court with a prayer that direction be given to the Superintendent of Police, Ballia, District Ballia, respondent no.2 to look into the matter and accordingly take appropriate decision into the matter directing the Investigating Officer for fair investigation in the matter as she apprehends that investigation is not being carried out in a fair and proper manner.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
It is further directed that the Superintendent of Police, Ballia, District Ballia shall supervise the investigation and ensure that the same is completed speedly without any undue delay.
With the above directions this petition is finally disposed of.
