Heard learned counsel for the applicants and learned A.G.A. For the State.
This criminal Misc. application has been filed by the applicants for quashing the entire proceedings of complaint case No.3786 of 2018 (old No.395 of 2017) (Vikram Singh Vs. Ruby and another) under Sections 406,323,504,506 I.P.C., P.S. Kurawali, District Mainpuri, in pursuance of the impugned summoning order dated 15.10.2018 passed by the learned Additional Chief Judicial Magistrate, Court No.1, Mainpuri.
It is submitted by the learned counsel for the applicants that no offence against them is made out and the summoning order has been passed in order to harass the applicants. He pointed out certain documents and statements in support of their contention. Learned A.G.A has accepted notice on behalf of the opposite party no.1.
Issue notice to opposite party no.2 returnable within four weeks at the address given in the application.
Steps be taken within one week.
Opposite parties may file their counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Until further orders of this court, entire proceedings of the aforesaid case shall remain stayed against the applicants.
