(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Learned counsel, Ms.Archana Amin, appearing for the appellant submitted that present petition is made with a prayer to set aside order dated 31.1.2005 in Original Application No.403 of 2004 of Central Administrative Tribunal, Ahmedabad. Subsequent to interim order dated 10.5.2005 herein, the Union of India has made order dated 26.9.2006, of which a copy is placed on record, and the original charge memo dated 22.1.2004 issued against the respondent is withdrawn and the disciplinary proceedings initiated against him are closed. Therefore, the petition does not survive for any further order and as such it is required to be disposed. No one is present for the respondent. The petition is disposed as not surviving and Rule is discharged with no order as to costs.
