R.Suriyaprabha vs The Superintendent Of Police

Madras High Court|28 July, 2017

JUDGMENT / ORDER

This Criminal Original petition is filed seeking a direction to the first respondent to give necessary direction to the second respondent to complete the investigation in Crime No.22 of 2017 and to file final report within the stipulated time.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. The case itself was registered recently in the month of April, 2017. The petitioner is the wife of one Rajthilak.
4. It is submitted that the petitioner's husband filed a Divorce petition against the petitioner in H.M.O.P.No.257 of 2017 before the learned Judge, Family Court, Madurai and that the petitioner also filed a petition in H.M.O.P.No.319 of 2017 against her husband for restitution of conjugal rights. In the meanwhile, the petitioner also filed D.V.O.P. Petition and Maintenance petition against her husband. It is in connection with the cases, the petitioner has also made a representation to the respondents to seize her husband's passport and hence, the bonafide of the petitioner is doubtful.
5. The allegations may not go well with the fact that the petitioner herself has filed a petition for restitution of conjugal rights. Having regard to the fact that several proceedings are pending before various forums between the husband and wife, this Court does not find any bonafides in this petition and hence, this Criminal Original petition is dismissed. To
1. The Superintendent of Police, Madurai District.
2. The Inspector of Police, Usilampatti All Women Police Station, Usilampatti, Madurai District.
3. The Additional Public Prosecutor, Madurai Bench of Madras High Court, Madurai.
