1.Issue Notice. Mr.C.Jagadish, learned Special Government Pleader, accepts notice on behalf of the respondents. With the consent of the learned counsels for parties, the writ petition is taken up for hearing and final disposal.
2.The petitioner says that there is apprehension that the subject TASMAC retail liquor shop referred to as shop no.12 may be closed of on the ground of alleged violation of Rule 8 of the Tamil Nadu Liquor Retail Vending (In Shops and Bars) Rules, 2003.
3.It is the contention of the learned counsel for the petitioner that the petitioner was called for a meeting on 28.01.2017 and post the deliberations at the meeting, he was asked to vacate the premises by 03.02.2017.
4.On being queried, learned counsel for the petitioner says that as yet, the subject TASMAC shop continues to operate from the premises in issue i.e., No.18, Manali Salai, Devi Karumari Amman Nagar, Korukupet, Chennai 600 021.
5.It is also submitted by the learned counsel for the petitioner that a representation dated 30.01.2017 has been sent to the respondents via speed post.
6.Mr.Jagadish, who appears for the respondent says that the representation will be considered, if so directed by this Court.
7.Accordingly, the writ petition is disposed of with direction to the respondents to consider the representation of the petitioner dated 30.01.2017. In this behalf, the petitioner will also be given a personal hearing in the matter. In case, any measurements have to be taken, the same will be taken in the presence of the petitioner. The record will be maintained of the measurements made. Needless to say, the aforementioned exercise will be carried out with due expedition, though, not later than four weeks from the receipt of a copy of the order.
8.The writ petition is disposed of, in the aforementioned terms. Consequently, the connected pending application is also closed. However, there shall be no order as to costs.
