R.Sornam vs The Superintendent Of Police

Madras High Court|21 February, 2017

JUDGMENT / ORDER

[Order of the Court was made by R.SUBBIAH, J.] Seeking production of the detenue viz., Sindhuja, D/o.Late.Sudalaikannu, aged about 21 years, the petitioner, who is the aunt of the detenue, has filed the present Habeas Corpus Petition, stating that the detenue was found missing from 31.10.2016 onwards and since her whereabouts was not known, a complaint was made before the second respondent, based on which, a case was registered in Crime No.401 of 2016, as "woman missing". However, no effective steps were taken to trace out the detenue so far. Hence, the petitioner has come up with the present petition.
2. Today when the matter was taken up for consideration, the second respondent produced the detenue before this Court. When we enquired the detenue, she told us that she fell in love with the third respondent herein and hence, on her own volition, she went along with him and both of them got married in a temple.
3. In view of the above said submission made by the detenue, we close the Habeas Corpus Petition leaving it open to the detenue to lead her own way of life.
