R.Saroja Alias R.Sasi vs The Registrar

Madras High Court|16 June, 2017

JUDGMENT / ORDER

This Writ petition has been filed by the petitioner seeking for issuance of Writ of Mandamus, directing the 1st respondent to publish the petitioner result of the B.Ed., Examination 2010 held in May/June, 2010 (Petitioner's Regn.No.1070209BD069)
2. The case of the petitioner is that he is a student of second respondent College during the academic year 2009-2010. The petitioner has joined the B.Ed. course in the Second Respondent college, only after seeing the publication made by the university. At that time the said college had a proper approval of the first respondent. At the time of conducting the B.Ed., course, the first respondent did not permit the students who joined the second respondent institution for writing the examination on the ground that the institution was not recognized by the first respondent, after 2010. Whileso, the second respondent approached this Court by filing a Writ Petition in W.P.No.7602 of 2010 seeking permission to allow the students to write examination. This Court, by an order dated 26.05.2010, has also issued interim direction permitting the students to appear for the examination and to withhold the result of the students subject to the outcome of the writ petition. Accordingly, the first respondent allowed the students to write the examination, including the petitioner and her classmates. However, the result have not been published even after completion of seven years. The second respondent has also not taken any steps to contest the Writ Petition in W.P.No.7602 of 2010. Since the results were not published, the students who have written the examination having joined the college at the time when it had approval and recognition were put to hardship. Hence the present Writ Petition has been filed seeking for the aforesaid relief.
3. Heard the learned counsel for the petitioner and the learned counsel appearing for the first respondent.
4. It is also pointed out that earlier this Court in W.P.No.30772 of 2013 batch etc.,, by orders dated 20.09.2013, 09.10.2014, 09.10.2015 had directed the 1st respondent University to publish the results of B.Ed., examination written by the petitioner therein subject to the attendance requirements.
5. The learned counsel for the first respondent would submit that pursuant to the said order, the results were published by the University.
6. Similarly, following the earlier order, this Court has allowed another Writ Petition in W.P.No.16264 of 2015, by an order dated 09.10.2015 and pursuant to the said order, the University has published the results.
7. Be that as it may, I fail to understand why each of the students who had written the examination in May/June 2010 are forced to file Writ Petitions to publish the individual results, when it is open to the University to publish the results of the entire batch. It is an admitted case that as on date, the students who had written the examination had Joined the B.Ed course when the college had valid recognition. Therefore, it is unnecessary to drive the students to get individual orders from the Court to get their results published.
8. The learned counsel for the first respondent also conceded that he will not have any objection in publishing the result of all the students who joined the 2nd respondent college when it had valid approval and recognitions rather than publishing the result of the students in instalments.
9. Accordingly, the first respondent is directed to publish the results of the B.Ed examination written by the petitioner and also those who have written the examination along with the petitioner and whose results have yet to be published, subject to the attendance and practical requirements, in one stroke, within a period of two weeks from the date of copy of receipt of this order and communicate to the individual students. It is also made clear that the University shall not wait for individual orders from each of the students for publication of the result of the examination held during May/June 2010.
10. This Writ Petition is disposed of accordingly. No costs. Consequently, connected Miscellaneous petition is closed.
