R.Saranya Devi @ Sindhu vs A.S.Pravin

Madras High Court|27 February, 2017

JUDGMENT / ORDER

H.M.O.P.No.37 of 2016 is filed by the respondent-husband for dissolution of marriage between the petitioner and respondent, before the Sub-Court, Bhavani. H.M.O.P.No.10 of 2016 is filed by the petitioner-wife for restitution of conjugal rights, which is also filed before the Sub-Court, Bhavani. Further, the petitioner-wife has filed M.C.No.46 of 2016 for maintenance before the Family Court, Erode. As the petitioner-wife is living in Erode, she has filed the said maintenance case before the Family Court, Erode. Hence, she prays for transfer of both the said H.M.O.Ps. to the file of the Family Court, Erode. The learned counsel for the respondent-husband fairly concedes that the respondent-husband has no serious objection for transfer of the said H.M.O.Ps. to Erode Court. Accordingly, these Tr.C.M.Ps. are ordered and H.M.O.P.Nos.10 and 37 of 2016 pending on the file of the Sub-Court, Bhavani, shall stand withdrawn and transferred to the Family Court, Erode, for trying along with M.C.No.46 of 2016. No costs. C.M.Ps. are closed.
