Mahantesh, AGA) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to quash the notice dated 30.06.2017 issued by respondent vide Annexure-B.
This Writ Petition coming on for ‘Orders’ this day, the Court made the following:-
ORDER In this proceeding, a memo is filed by learned counsel for the petitioner seeking permission of this Court to withdraw the writ petition on the premise that it has become infructuous.
2. Office has raised an objection on the said memo on the count that the petitioner has not affixed signature on the memo for withdrawal of the writ petition.
3. However, learned Additional Government Advocate brings to the notice of this Court that the petitioner has challenged levy of tax in a sum of Rs.83,000/- due to different departments and it was ordered to be recovered in the form of arrears of land revenue. The said amount has already been recovered. Therefore, nothing survives for consideration in this petition.
4. In that view of the matter, the memo filed by petitioner is taken on record. The writ petition is dismissed as it does not survive for consideration.
