JUDGMENT / ORDER

Antony Dominic, J. C.M.Appln.No.1234 of 2014
1. This is an application filed to condone the delay of 142 days in filing the review petition. The respondent did not oppose the prayer and therefore, the delay is condoned.
R.P.No.325 of 2014
2. The prayer sought for is to review the judgment in Mat.A.577/10. The main ground pointed out by the learned counsel for the petitioners is that Rs.2,26,000/- already paid by them to the respondent is not ordered to be given credit to when the decree is executed before the Family Court.
3. The fact that Rs.2,26,000/- has been paid to her is not disputed by the respondent. On the other hand, what she contends is that in the execution petition, RP.325/14 2 her claim is for the amount after giving credit to the payment so received.
4. In the light of the above, the judgment is clarified that while the claim of the decree holder is settled, the Family Court will take note of the statements made by the respective sides before this Court today.
RP ordered accordingly.
