For Appellant : Mr.K.C.Ramalingam For Respondent : Ms.J.Anandhavalli :COMMON JUDGMENT Both these Civil Miscellaneous Second Appeals arise out of the matrimonial proceedings. The parties have settled the dispute before the Mediation and Conciliation Centre attached to this Bench and the report of the Mediators, dated 24.04.2017, is also filed.
2. As per the said settlement arrived between the parties, the wife has agreed for grant of divorce and she has also been paid a lumpsum amount of permanent alimony. She has also taken back her belongings.
3. Hence, both the Civil Miscellaneous Second Appeals are allowed and the judgment and decree dated 05.03.2016 passed by the lower appellate Court in C.M.A.Nos.30 and 29 of 2015 are set aside and the judgment and decree of the trial Court in H.M.O.P.Nos.125 of 2009 and 219 of 2010 are restored. No costs. Consequently, the connected civil miscellaneous petitions are closed.
