JUDGMENT / ORDER

This Criminal Revision has been filed by the petitioner seeking to set aside the order dated 29.10.2014 in C.C.No.193 of 2013 on the file of the Fast Track Judicial Magistrate, Vellore.
2. Revision petitioner is the complainant in a private complaint filed under Section 138 of Negotiable Instruments Act. Based on the complaint given by the petitioner, the Court below taking cognizance of the offence had taken the complaint on file in C.C.No.193 of 2013. The court below however, passed an order stating that the drawee bank is not within the jurisdiction of the court and hence ordered to transfer the case to the jurisdictional court. Challenging the said order the petitioner has filed the present revision.
3. Learned counsel appearing for the revision petitioner would submit that in view of the subsequent amendment made in the Negotiable Instruments Act, the Court below i.e., learned Judicial Magistrate, Vellore will have the jurisdiction. In the above circumstances, revision petitioner wants to withdraw this Criminal Revision Petition to pursue the C.C. with the same court and he has also made an endorsement to that effect.
4. Recording the endorsement made, this Criminal Revision Case is dismissed as withdrawn.
