The present petition is a second writ petition practically for the same cause of action.
The petitioner is facing recovery proceedings under Securitization and Reconstruction of Financial Assets and Enforcement of Securities Act. In connection with the said proceedings, the petitioner has filed earlier petition challenging the sale notice and this petition is for challenging the notice of e-auction.
In view of the above, as second petition for the same cause of action is not maintainable, counsel for the petitioner submits that it may be dismissed as withdrawn so that he may pursue the earlier petition on merits.
In view of the above, the writ petition is dismissed as not maintainable.
