JUDGMENT / ORDER

Being aggrieved of Ext.P1 assessment order, the petitioner has preferred ExtP2 appeal along with Ext.P3 petition for stay before the second respondent/Deputy Commissioner. After considering the I.A. for stay, the appellate authority passed Ext.P4 order directing the petitioner to satisfy 30% of the disputed liability so as to avail the benefit of interim stay, which made the petitioner to approach this Court by filing this writ petition.
2. Heard the learned Counsel for the petitioner as well as the learned Government Pleader appearing for the respondents.
3. After hearing both the sides and after going through the materials on record, this Court finds that the condition has been imposed by the appellate authority also with reference to the materials disclosed from the assessment order, copy of which has been produced as Ext.P1.
4. This Court does not find any tenable ground to interfere with the condition imposed by the appellate authority. However, considering the persuasive submission made by the learned W.P.(C)No. 33343 OF 2014 2 Counsel for the petitioner, the time to satisfy the condition is extended and the petitioner is permitted to satisfy '15%' of the disputed liability within two weeks and another '15%' within two weeks thereafter, to top up the figure to make it 30% of the total, as ordered by the appellate authority vide Ext.P4 order dated 10.11.2014.
The writ petition is disposed of.
