This court (Coram: K.S.Jhaveri, J) by an order dated 13.03.2012 has passed the following order:
"Rule.
By way of ad-interim relief, the impugned award is stayed only qua the direction regarding continuity of service and grant of 50% back wages on condition that the respondent No.1 shall be reinstated before the next date of hearing.
Notice for confirmation of interim relief returnable on 11.04.2012."
Thereafter the matter was listed on 19.04.2012 and Mr.Pandya, learned advocate for the petitioner, requested for time to place on record the relevant documents to show that as per communication dated 13.03.2012 the respondent-workman has been reinstated as per condition of the said order. Mr.Pandya, learned advocate for the petitioner, tenders a photocopy of communication dated 15.03.2012 signed by the respondent-workman along with a photocopy of the statements of "attendance clock stamping" for the months of March, 2012 as well as April, 2012, copies of the said three documents have also been handed over to Mr.Dholakia, learned advocate appearing for Mr.Harnish V.Darji, who has instructions to appear on behalf of the respondent-workman.
Considering the aforesaid facts, the condition imposed by this Court while granting ad-interim relief qua continuity of service as well as grant of 50% back wages stands complied with. Hence, ad- interim relief granted earlier to continue as interim relief till the final disposal of this petition.
