JUDGMENT / ORDER

Fortunately for this Court it become unnecessary to adjudicate the issue for the simple reason that the parties have agreed that the impugned order cannot be sustained in the light of the decree passed in the suit and they pray that they may be allowed to put up compound wall as per the boundary fixed as per the decree. 2. In the result, this original petition is allowed and the impugned order is set aside and the matter is remanded to the trial court with a direction to issue appropriate orders as are necessary permitting the parties to put up compound wall in terms of the boundary fixed in the decree within a period of one month from the date of appearance of parties. The parties to appear before the trial court on 16.12.2014.
