Rosi Foundation vs K.Dharmar

Madras High Court|24 March, 2017

JUDGMENT / ORDER

Heard Mr.S.Arunachalam, learned counsel appearing for the petitioner and Mr.M.Rajarajan, learned Government Advocate appearing for the respondent and perused the materials produced.
2. The petitioner has filed this contempt petition against the respondent alleging disobedience of the directions issued by this Court, on 15.07.2014, in W.P.(MD) No.11539 of 2014.
3. On perusal of the order, dated 15.07.2014, it is seen that the writ petition was dismissed with certain observations. This Court specifically directed that if the petitioner fails to vacate the premises on or before 31.08.2014, the respondent is entitled to evict him from the premises.
4. The learned Government Advocate appearing for the respondent, on instructions, submitted that the petitioner has not vacated the premises and till date he is running the multipurpose centre in the premises, which is in violation of the directions issued by this Court. Hence, it is the petitioner, who is guilty of contempt. This Court is, therefore, of the view that no contempt is made out.
5. In the result, the contempt petition fails and it is dismissed. No costs.
