The above O.P. is filed by the respondent in O.P.No.560/2010, pending before the Family court, Thiruvalla, with a prayer to issue a direction to the court below for an early disposal of the above O.P. along with O.P.No.489/09.
2. When the above case was taken on 22.5.2014, the learned counsel who was present on that day sought for an adjournment to ascertain whether the matter has been settled or not. Thus we have posted the case to 29.5.2014, on which date also there was no representation for the petitioner even though the case was passed over. Noting the failure on the part of the counsel, we suo motu adjourned the case to a date after 10 days and thus it is O.P.(F.C.)No.249 of 2014 2 came up for consideration on today. Today also there is no representation. From the averments contained in the O.P. it appears that all the proceedings in the above two cases were over and there were several postings for judgment and finally on 13.5.2014, there was a posting in the trial court for judgment. We don't know the present position of the case in the trial court. However, today also, the counsel for the petitioner is absent, which shows that neither the petitioner nor her counsel is interested in prosecuting the matter.
In the result, this O.P. is dismissed for non prosecution.
