Heard learned counsel for the petitioner and the learned Standing Counsel.
The petitioner is claiming the benefit of Mukhyamantri Kisan Evam Sarvahit Bima Yojana on the death of Nasir Ali. The claim of the petitioner has not been accepted so far by the insurance company on certain technical defects namely that the claim has been presented beyond time by 45 days and that the income certificate was not on proper format. It has also appeared that the someone else is also claiming benefit on account of death of aforesaid Nasir Ali.
The insurance company with the above observation has referred the matter to the District Magistrate, now it is open for the District Magistrate to consider the claim of the petitioner and to pass appropriate orders in accordance with law. The District Magistrate has not yet passed any order at least it is not evident from the petition.
In view of the above, we are of the view that the petition is premature. The petitioner should pursue the his claim before the District Magistrate concerned.
With the aforesaid observation, the writ petition is disposed of.
