THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO SET ASIDE THE ENDORSEMENT ISSUED BY THE R-3 DTD.12.12.2016 VIDE ANNEX-G AND CONSEQUENTLY DIRECT THE RESPONDENTS TO REGISTER THE PROPERTY TO THE NAME OF THE PETITIONER, AND ETC.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri.Prasanna D.P., learned counsel for the petitioner.
Ms.Aparna R., learned counsel for Sri.B.Prasanna Kumar, learned counsel for the respondent Nos.1 to 3.
2. The petition is admitted for hearing. With consent of the learned counsel for the parties, the same is heard finally.
3. In this petition, the petitioner inter alia seeks quashment of endorsement dated 12.12.2016.
4. When the matter was taken up today, learned counsel for the petitioner submitted that even though he is an auction purchaser, however the sale certificate is not being issued in his favour by the respondent – Bank.
5. In view of the aforesaid submissions, learned counsel for the respondent – Bank submits that the sale certificate in favour of the petitioner shall be issued within a period of four weeks from today. The aforesaid statement is taken on record.
6. In view of the aforesaid submissions, nothing survives for adjudication in this writ petition.
Accordingly, the petition is disposed of.
