The sole relief pressed for by learned counsel for the petitioner at the time of hearing of this petition is that Greater Noida Industrial Development Authority, Greater Noida, Gautam Budh Nagar may take a decision for lease back of land in favour of the petitioner in accordance with the Greater Noida Industrial Development Rural Abadi Sites (Management and Regularisation) Regulations, 2011 as amended in 2015.
Sri B.B. Jauhari, learned counsel appearing for Greater Noida has stated that it is for the petitioner to submit an application in accordance with the aforesaid Regulations and in case such an application is filed, a decision shall be taken at an early date.
This writ petition is, accordingly, disposed of with a direction that in the event the petitioner files an application for lease back of the land with a certified copy of this order before the Competent Authority, a decision shall be taken in terms of the Regulations 2011 as amended in 2015 expeditiously and preferably within a period of three months from the date of filing of the application.
It is made clear that the Court has not adjudicated on the merits of the case and it will be for the authority concerned to take a decision in accordance with law.
