The challenge is to the notice dated 10.02.2021 issued by respondent no.3 whereby the petitioner has been called upon to remove the unauthorized occupation over the land in question. The contention of the learned counsel for the petitioner is that the notice itself is illegal.
The petitioner had submitted reply to the notice on 11.02.2021 by registered post which is appended at page-'13' of the paper book.
Considering the above, without entering into the merits of claim of the petitioner, the present writ petition is being disposed of with the direction to the respondent no.3- Executive Officer, Nagar Palika Parisad, Kakrala, District Budaun to consider the explanation offered by the petitioner and take an expeditious decision in the matter of show cause notice dated 10.02.2021 by passing a reasoned and speaking order in accordance with law, in an expeditious manner.
