Prayer : This Civil Revision Petition has been filed under Section 25 of the Tamil Nadu Buildings (Lease and Rent Control) Act 18 of 1960 as amended by Act 23 of 1973 and Act 1 of 1980), praying to set aside the order of the learned Rent Control Appellate Authority, VIII Small Causes Court, Chennai dated 12.11.2013 made in RCA No.554 of 2010 reversing the order of the learned Rent Controller,
XII Small Causes Court, Chennai dated 11.02.2010 made in RCOP.No.347 of 2008 dismissing the RCOP for eviction filed by the respondent.
For petitioner : Mr.D.Moses Jeyarajan For Respondents : Mr.B.Natarajan O R D E R Learned counsel for the petitioner seeks permission of this Court to withdraw the Criminal Revision Case and he has also made an endorsement to that effect.
2. The learned counsel for the petitioner has made an endorsement as follows:-
"The petitioner has vacated the petition premises as on today and handed over the key and EB card to respondent today after receiving the DDs for a total sum of Rs.2,50,000/-. Hence, the petitioner prays the CRP may be dismissed as not pressed."
3. The learned counsel for the respondent has made an endorsement as follows:-
"Key and E.B.card for the petitioner premises has been handed over and acknowledged. The Demand Draft for Rs.2.5 lakhs paid to the revision petitioner today i.e.,31.01.2017."
4. Recording the above said joint endorsements made by both the counsels that the revision petitioner/tenant has vacated the premises and handed over the key and E.B.card to the respondent after receiving a sum of Rs.2,50,000/- by way of Demand Draft today, this revision is dismissed as not pressed. Consequently, connected Miscellaneous Petition is closed. No costs.
