The petitioners have filed the above writ petition contending that they are entitled to debt relief under the Kerala Farmers Debt Relief Commission Act, 2006 (for brevity 'the Act of 2006') The prayer is for a direction to the 2nd respondent being the Kerala Farmers Debt Relief Commission, to dispose of the petition filed by the petitioners herein. 2. The Government had filed a counter affidavit on 12.06.2012 contending that the present Commission was constituted as per the Government notification dated 07.06.2012 and cases are taken up on the basis of priority given to extremely distress affected areas in the districts of Wayanad and Idukki. It was also undertaken that the case of the petitioners will WP(C).11340/12 2 be disposed of expeditiously. The petitioners also do not, at this point of time, have a contention that they were not heard. They were in fact, pursuant to the filing of the writ petition, heard by the Debt Relief Commission. The Commission found that the petitioners are not entitled for any relief under the Act of 2006. The orders, by which the Commission rejected their claims, are produced as Exts.R2 (a) to R2(d) in the additional counter affidavit dated 02.07.2013 filed by the Government. The petitioners have not chosen to challenge the same.
3. The learned counsel for the petitioners would contend that, he has material to show that the petitioners were in fact, engaged in agricultural operations. However, it is too late in the day to press for a remand, especially since the petitioners have not chosen to WP(C).11340/12 3 challenge any of the orders passed by the Kerala State Farmers' Debt Relief Commission, Thiruvananthapuram.
The writ petition hence, would stand dismissed, leaving the parties to suffer their respective costs.
