Heard learned counsel for the applicant, learned counsel for the complainant as well as learned A.G.A.
By means of this application, the applicant who is involved in case crime no.102 of 2020, under Sections 376(2)(N) and 342 of IPC, Police Station-Baheri, District-Bareilly, is seeking enlargement on bail during the trial.
Submission made by learned counsel for the applicant is that the applicant is a practicing lawyer. It is next contended that Gyano Devi, mother of the victim has lodged the FIR against the applicant with the allegation that her daughter who is also an Advocate, was ravished by the applicant. The 164 Cr.P.C. statement coupled with the medical evidence clearly indicates that she was subject matter of sexual assault by the applicant.
Being a practicing advocate of this nobel profession, the standard and bar of morality and ethics would be much higher, than those of we apply ordinarily in other general cases. No special treatment would be given to the applicant, who allegedly is a professional. This accusation have been made by none other than her own colleague. The applicant should be role model to the society at large but, he himself is indulged in this shameful offence, thus deserves no sympathy.
Under the circumstances, I do not find any good reason to grant indulgence in favour of the applicant.
