ORDER:
This writ petition is filed for a mandamus to declare the action of the respondents in not declaring the result of the petitioner in Mathematical Foundation of Computer Science of I year M.Tech., (I Semester) Supplementary Examinations as illegal and arbitrary.
Though notices were served on respondent Nos.2 and 3 and acknowledgments in proof of service is filed, no one entered appearance for them.
I have heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Technical Education (AP) appearing for respondent No.1 and perused the record.
The petitioner has joined M.Tech., Course in respondent No.3-College after getting qualified in P.G. Eligibility Common Entrance Test, 2011 for the academic year 2011-12. The petitioner pleaded that he had two backlog subjects in I Year (I Semester), that in revaluation, he has passed one subject i.e., Computer Organisation and Architecture (C5803) and that therefore, he appeared for another subject i.e., Mathematical Foundation of Computer Science (C5802) in the Supplementary Examinations. Respondent No.3 while registering the name of the petitioner for Supplementary Examinations has given hall ticket bearing No.12G51D5806 evidently by mistake. Realising the said mistake, respondent No.3 has addressed letter, dated 05.03.2014, to respondent No.2 wherein it has informed the latter that the actual hall ticket number of the petitioner is 11G51D5806 and that by mistake, his hall ticket number was wrongly mentioned as 12G51D5806 which belongs to another student who has already passed the said examination. The petitioner specifically stated that based on the said communication, respondent No.2 permitted the petitioner to appear for the examination on 05.03.2014.
As the petitioner’s result was withheld, respondent No.3 has addressed another letter, dated 16.08.2014, to respondent No.2 wherein it has clarified that the actual hall ticket number of the petitioner is 11G51D5806 and requested the said respondent to verify and announce the petitioner’s result. As no action has been taken, the petitioner has filed this writ petition.
From the letters, dated 05.03.2014 and 16.08.2014, addressed by respondent No.3 to respondent No.2, it is evident that because of the mistake committed by respondent No.3, the petitioner’s hall ticket number was wrongly mentioned. The petitioner therefore cannot be penalised for the said mistake. Respondent No.2 is therefore directed to announce the result of the petitioner in Mathematical Foundation of Computer Science (C5802) written by him on 05.03.2014, by treating his hall ticket number as 11G51D5806, within one week from the date of receipt of a copy of this order and communicate the same to respondent No.3- College.
Subject to the above direction, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.Nos.37510 & 37511 of 2014 shall stand disposed of as infructuous.
