Heard learned counsel for the petitioner; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 30.10.2019 registered as Case Crime No.209 of 2019, under Sections 354, 323, 504, 376-D IPC, P.S. Devgaon, District Azamgarh.
The allegations made in the impugned first information report disclose commission of cognizable offence and later when the statement of the victim under Section 164 Cr.P.C. was recorded she has also levelled allegation of sexual assault The contention of the learned counsel for the petitioner is that the victim has alleged that she has been assaulted physically also but she has not sustained any injury.
Be that as it may, as the allegations find support from the statement of the victim under Section 164 Cr.P.C., the prayer to quash the first information report is misconceived. The petition is dismissed.
