Heard Mr. Padhya, learned advocate for the petitioners, Mr. Tejas Barot, learned advocate for the respondents no. 4 & 5 and Mr. H.S. Soni, learned AGP appearing for the respondent no. 1.
In view of the fact that the three orders passed by the competent authority, more particularly, orders/letters dated 29.08.2008, 05.01.2010 and 04.10.2010 passed by the Assistant District Registrar which have neither been set aside or stayed by a higher forum, the petitioners are entitled to reap the fruits of these orders/letters passed by the competent authorities. In that view of the matter, the respondents no. 4 & 5 shall, as a last chance, implement the aforesaid orders/letters within a period of three weeks from today failing which the petitioners shall be deemed to be the members of the society. Direct service is permitted today.
