JUDGMENT / ORDER

RULE.
Learned Additional Public Prosecutor Mr. L.B. Dabhi waives service of notice of Rule for the respondent - State.
The applicant has preferred this application for grant of temporary bail for a period of 5 days on the ground of executing the Sale Deed before the Sub-Registrar's Office. The present applicant is arrested in connection with First Information Report registered as I-C.R. No.131/2011 with Jagadia Police Station, Bharuch for the offences punishable under Sections 302, 201 and 114 of the Indian Penal Code.
Learned Counsel for the applicant submits that the applicant is in jail since 23.05.2012. An application was made before the concerned Court for temporary bail for a period of five days for executing the Sale Deed. The same was rejected by the Sessions Court and hence, this application has been filed.
It is submitted by the learned Counsel for the applicant that if the applicant is released on temporary bail for executing the Sale Deed, the cost of police escort will be borne by the applicant.
In view of the averments made in this application, I deem it just and proper to enlarge the applicant on temporary bail for a period of two (2) days only, i.e. from 17th to 18th May, 2012, on furnishing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) with a like amount of surety, before the concerned Trial Court and on completion of the period of temporary bail, the applicant shall surrender in time.
It is clarified that the cost of police escort will be borne by the applicant.
With the aforesaid observation and direction, this application is allowed. Rule made absolute to the aforesaid extent. Direct Service is permitted.
