Sri Devesh Saxena, learned counsel for the petitioners and Sri Amit Sinha, learned AGA for the State.
This writ petition has been filed by the petitioners seeking quashment of FIR No.0019/2020 under Sections 498-A, 323, 376, 511 of IPC and Sections 3 and 4 of Dowry Prohibition Act at Police Station Mahila Thana, District Saharanpur.
Counsel for the petitioners submits that present FIR is nothing but a bundle of incorrect facts where false allegations have been levelled against the entire family. He submits that earlier on 4.10.2019, a complaint case was filed before the competent Court, wherein different allegations have been levelled and now improving all those allegations, present FIR has been lodged. He further submits that present FIR is nothing but an after thought, just to pressurize the petitioners to agree with the demand raised by the complainant.
On instructions, learned counsel for the petitioners, prays for withdrawal of this petition with liberty to file anticipatory bail application before the competent Court. He also prays that in the eventuality of filing such application by the petitioners, the competent Court be directed to decide the same expeditiously considering all the aspects of the case, including the allegations made in the earlier complaint.
State Counsel has no objection to this proposition.
Petitioners are, accordingly, permitted to withdraw this petition with the aforesaid liberty.
Needless to state that in the eventuality of filing anticipatory bail application by the petitioners before the competent Court, the competent Court shall decide the same expeditiously in accordance with law considering all the aspects of the case.
Petition is dismissed as withdrawn.
The party shall file a computer generated copy of this order downloaded from the official website of High Court Allahabad, self-attested by the petitioners, along with a self-attested identify proof of the said person (s) (preferably Aadhar Card).
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
